Hadith 29:97
Marwan ibn Mu'awiyah narrated to us, from Humayd, from Anas, who said: We besieged Tustar, and al-Hurmuzan descended upon the judgment of Umar. Abu Musa sent him with me. When we arrived before Umar, al-Hurmuzan remained silent and did not speak. Umar said to him, "Speak." He said, "Is it the speech of the living or the speech of the dead?" He said, "Speak, for there is no harm." He said, "We and you, O assembly of the Arabs, as long as God left us and you alone, we used to kill you and drive you away. But when God was with you, we had no power against you." Umar said, "What do you say, O Anas?" I said, "O Commander of the Faithful, I left behind a severe threat and a great number. If you kill him, the people will despair of life, and it will be more intense for their threat. And if you spare him, the people will have hope." He said, "O Anas, shall I spare the killer of al-Bara' ibn Malik and Mujza'ah ibn Thawr?" When I feared that he would lay his hand upon him, I said, "There is no way to kill him." Umar said, "Why? Did I give you [permission] to strike him?" I said, "I did not do that, but you said to him, 'Speak, for there is no harm.'" He said, "You shall bring someone who testifies, or I will begin with your punishment." I went out from his presence, and suddenly I was with al-Zubayr, who had memorized what I had memorized, so he testified before him. He then spared him, and al-Hurmuzan accepted Islam, and he [Umar] assigned him a stipend.
حدثنا مروان بن معاوية عن حميد عن أنس قال حاصرنا تستر فنزل الهرمزان على حكم عمر فبعث به أبو موسى معي فلما قدمنا على عمر سكن الهرمزان ولم يتكلم فقال له عمر تكلم فقال أكلام حي أم كلام ميت قال تكلم فلا بأس قال إنا وإياكم معشر العرب ما خلى الله بيننا وبينكم فانا كنا نقتلكم ونقصيكم ولما أن كان الله معكم لم يكن لنا بكم يدان فقال عمر ما تقول يا أنس قلت يا أمير المؤمنين تركت خلفي شوكة شديدة وعددا كثيرا إن قتلته أيس القوم من الحياة وكان أشد لشوكتهم وإن استحييته طمع القوم فقال يا أنس استحيى قاتل البراء بن مالك ومجزأة بن ثور فلما خشيت أن يبسط عليه قلت ليس إلى قتله سبيل فقال عمر لم أعطاك أصبت منه قلت ما فعلت ولكنك قلت له تكلم فلا بأس قال لتجيئن بمن يشهد أو لأبدأن بعقوبتك قال فخرجت من عنده فاذا أنا بالزبير قد حفظ ما حفظت فشهد عنده فتركه وأسلم الهرمزان وفرض له
