Hadith 19:329

Abu Bakr narrated to us, he said: Ibn Mushir narrated to us, from al-Shaybani, from Hassan ibn Makhariq, he said: It reached me that Umar ibn al-Khattab was traveling with a man on a journey, and he (the man) was fasting. When he broke his fast, he reached for a waterskin of Umar’s that was hanging, in which there was nabidh (fermented date drink) that the camel had shaken, so he drank from it and became intoxicated. Umar struck him with the prescribed punishment (hadd). The man said to him, "I only drank from your waterskin." Umar said to him, "We only flogged you for your intoxication."

حدثنا أبو بكر قال حدثنا بن مسهر عن الشيباني عن حسان بن مخارق قال بلغني أن عمر بن الخطاب ساير رجلا في سفر وكان صائما فلما أفطر أهوى إلى قربة لعمر معلقة فيها نبيذ قد خضخضها البعير فشرب منها فسكر فضربه عمر الحد فقال له إنما شربت من قربتك فقال له عمر إنما جلدناك لسكرك
