Musannaf Ibn Abi Shayba 19:58

Abu Bakr narrated to us, he said: Muhammad ibn Bakr narrated to us, from Ibn Jurayj, he said: 'Ata' used to say: If he steals and drinks wine, then commits murder, then it is the execution (qisas). He is not to have his hand cut off, nor is he to be given the prescribed punishment (hadd).
