Hadith 19:593
Abu Bakr narrated to us, he said: Muhammad ibn Bishr narrated to us, from Sa’id, from Qatada, that a young boy snatched a necklace. He was brought to Adi ibn Artah, so he asked al-Hasan about that. He said: "There is no cutting [of the hand] for him." He also asked Iyas ibn Mu’awiyah about that, and he ordered his cutting. When they differed regarding that, he wrote to Umar ibn Abd al-Aziz about it. Umar wrote back to him: "The Arabs used to call it 'the transgression of midday' (adwat al-zahira). There is no cutting for him, but make his back ache [with lashes] and prolong his imprisonment."
حدثنا أبو بكر قال حدثنا محمد بن بشر عن سعيد عن قتادة أن غلاما اختلس طوقا فرفع إلى عدي بن أرطاة فسأل الحسن عن ذلك فقال لا قطع عليه وسأل عن ذلك إياس بن معاوية فأمر بقطعه فلما اختلفا كتب في ذلك إلى عمر بن عبد العزيز فكتب إليه عمر إن العرب كانت تدعوها عدوة الظهيرة لا قطع عليه ولكن أوجع ظهره وأطل حبسه
