Musannaf Ibn Abi Shayba 19:6

Abu Bakr narrated to us, he said: Waki’ narrated to us, from Sa’id ibn ‘Ubayd, from Sulayman ibn Abi Kabsha, that a thief was passed by him to Sa’id ibn Jubayr and ‘Ata’, so they interceded for him. It was said to them, "Do you see that [as permissible]?" They said, "Yes, as long as he has not been brought to the Imam."
