Hadith 19:688
Abu Bakr narrated to us, he said: Muhammad ibn Fudayl narrated to us, from Husayn, from Bakr, who said: A woman married her slave. It was said to her [regarding this], and she said: "Does Allah not say: '...and those whom your right hands possess' (4:24)? So this is by my right hand." And a woman married without evidence or a guardian. It was said to her [regarding this], and she said: "I am a previously married woman (thayyib), and I have authority over my own affairs." So the matter was raised to Umar. He gathered the people and asked them, and they said: "We have disputed with you by the Book of Allah, Majestic is His Majesty." Ali said: "I have disputed with you by the Book of Allah." So he (Umar) flogged each one of them one hundred lashes. Then he wrote to the provinces: "Any woman who marries her slave, or marries without a guardian, she is in the status of an adulteress."
حدثنا أبو بكر قال حدثنا محمد بن فضيل عن حصين عن بكر قال تزوجت امرأة عبدها فقيل لها فقالت أليس الله يقول @QB@ وما ملكت أيمانكم @QE@ فهذا بملك يميني وتزوجت امرأة من غير بينة ولا ولي فقيل لها فقالت أنا ثيب وقد ملكت أمري فرفعت إلى عمر فجمع الناس فسألهم فقالوا قد خاصمناك بكتاب الله جل جلالة وقال علي قد خاصمتك بكتاب الله فجلد كل واحد منهما مائة جلدة ثم كتب إلى الأمصار أيما امرأة تزوجت عبدها أو تزوجت بغير ولي فهي بمنزلة الزانية
