Musannaf Ibn Abi Shayba 19:765

Abu Bakr narrated to us, he said: Abd al-Rahim ibn Sulayman narrated to us, from al-Mujalid, from al-Sha’bi, from Suwayd ibn Ghafala: That a man from the people of the covenant (ahl al-dhimma), from the Nabataeans of the people of al-Sham, poked a woman who was on a riding beast, but she did not fall. Then he pushed her with his hand, so she fell, and her clothes became uncovered. He then sat down to have intercourse with her. He was brought before Umar ibn al-Khattab, and the evidence was established against him. He ordered that he be crucified, and he said: "It is not upon this that we made a covenant with you."
