Hadith 19:848
Abu Bakr narrated to us, he said: Muhammad ibn Bakr narrated to us, from Ibn Jurayj, he said: Ma’mar informed me, from Khasif, he said: A people missed some of their goods from their house, and they saw a hole in the house. They went out looking, and behold, two men were running. They caught one of them, who had their goods with him, and the other escaped from them. He said: So they brought him [to the authorities], and he said: "I did not steal anything; rather, this man who escaped hired me and handed these goods to me to carry for him. I do not know where he got them from." Khasif said: So they wrote about this to Umar ibn Abd al-Aziz. He wrote back that he should be punished (ta’zir) and imprisoned for life, and that his hand should not be cut off.
حدثنا أبو بكر قال حدثنا محمد بن بكر عن بن جريج قال أخبرني معمر عن خصيف قال فقد قوم متاعا لهم من بيتهم فرأوا نقبا في البيت فخرجوا ينظرون فإذا رجلان يسعيان فأدركوا أحدهما معه متاعهم وأفلتهم الآخر قال فأتينا به فقال لم أسرق شيئا وإنما أستأجرني هذا الذي أفلت ودفع إلي هذا المتاع لأحمله له لا أدري من اين جاء به قال خصيف فكتب به إلى عمر بن عبد العزيز فكتب أن ينكل ويخلده السجن ولا يقطعه
