Hadith 19:945

Abu Bakr narrated to us, he said: Muhammad ibn Bakr narrated to us, from Ibn Jurayj, he said: It was narrated to me from Sa’id ibn Jubayr, he said: "Whoever wages war is a *muharib* (warrior/aggressor)." Sa’id said: "If he sheds blood, he is killed. And if he sheds blood and takes wealth, he is crucified, for crucifixion is the most severe. And if he takes wealth and does not shed blood, his hand and his foot are cut off, due to the saying of Allah, Majestic is His Majesty: '...or their hands and their feet be cut off from opposite sides.' And if he repents, then his repentance is between him and Allah, but the prescribed punishment (*hadd*) is carried out upon him."

حدثنا أبو بكر قال حدثنا محمد بن بكر عن بن جريج قال حدثت عن سعيد بن جبير قال من حارب فهو محارب قال سعيد فإن أصاب دما قتل وإن أصاب دما ومالا صلب فإن الصلب هو أشد وإذا أصاب مالا ولم يصب دما قطعت يده ورجله لقول الله جل جلاله @QB@ أو تقطع أيديهم وأرجلهم من خلاف @QE@ فإن تاب فتوبته بينه وبين الله ويقام عليه الحد
