Hadith 26:163
Muhammad ibn Fudayl narrated to us, from Bassam, from Fudayl, who said: Ibrahim said regarding a woman who left behind her sister from her father and mother, and her sister from her father, and she had no agnate (asaba) other than them: For her sister from her father and mother is three-quarters, and for her sister from her father is one-quarter, according to the judgment of Ali. Abdullah judged that for the sister from the father and mother is five shares, and for the sister from the father is one-sixth. Zayd judged regarding it that for the sister from the father and mother is three shares, and for the sister from the father is one-sixth, and what remains is for the public treasury (Bayt al-Mal) if there is no clientage (wala') or agnate. Abu Bakr said: This, according to the statement of Ali, is out of three shares, and according to the statement of Abdullah and Zayd, it is out of six shares.
حدثنا محمد بن فضيل عن بسام عن فضيل قال قال إبراهيم في امرأة تركت أختها لأبيها وأمها وأختها من أبيها ولا عصبة لها غيرهما فلأختها لأبيها وأمها ثلاثة أرباع ولأختها من أبيها الربع في قضاء علي وقضى عبد الله أن للأخت من الأب والأم خمسة أسهم وللأخت من الأب السدس وقضى فيها زيد أن للأخت للأب والأم ثلاثة اسهم وللأخت للأب السدس وما بقي لبيت المال إذا لم يكن ولاء ولا عصبة قال أبو بكر فهذه في قول علي من ثلاثة أسهم وفي قول عبد الله وزيد من ستة أسهم
