Hadith 26:230
Yazid ibn Harun narrated to us, he said: Muhammad ibn Salim informed us, from al-Sha'bi, regarding a sister of the same father and mother, a brother and sister of the same father, and a grandfather: In the opinion of Ali: For the sister of the same father and mother is one-half, and what remains is between the grandfather, the sister, and the brother of the same father in fifths; for the grandfather are two-fifths, and for the sister is one-fifth. In the opinion of Abdullah: For the sister of the same father and mother is one-half, and for the grandfather is what remains, and there is nothing for the brother and sister of the same father. In the opinion of Zayd: Out of eighteen shares, for the grandfather is one-third (six), for the brother of the same father is six, for the sister of the same father and mother is three, and for the sister of the same father and the brother and sister is three. Then the brother of the same father returns to the sister of the same father and mother six shares, so she completes the half (nine), and there remain for them three shares; for the brother are two shares and for the sister is one share. Regarding two sisters of the same father and mother, a brother of the same father, and a grandfather: In the opinion of Ali: For the two sisters of the same father and mother are two-thirds, and what remains is between the grandfather and the brother. In the opinion of Abdullah: For the two sisters of the same father and mother are two-thirds, and for the grandfather is what remains, and there is nothing for the brother of the same father. In the opinion of Zayd: It is three shares; for the grandfather is one share, for the brother is one share, and for the two sisters is one share. Then the brother of the same father returns his share to the two sisters of the same father and mother, so they complete the two-thirds, and nothing remains for him. Regarding two sisters of the same father and mother, a sister of the same father, and a grandfather: In the opinion of Ali and Abdullah: For the two sisters of the same father and mother are two-thirds, and what remains is for the grandfather, and there is nothing for the sister of the same father. In the opinion of Zayd: Out of five shares, for the grandfather are two shares, for the two sisters of the same father and mother are two shares, and for the sister of the same father is one share. Then the sister of the same father returns her share to the two sisters of the same father and mother, and nothing remains for her. Regarding two sisters of the same father and mother, a brother and two sisters of the same father, and a grandfather: In the opinion of Ali: For the two sisters of the same father and mother are two-thirds, for the grandfather is one-sixth, and what remains is between the brother and the two sisters of the same father, for the male the like of the portion of two females. In the opinion of Abdullah: For the two sisters of the same father and mother are two-thirds, for the grandfather is what remains, and there is nothing for the brother and the two sisters of the same father. In the opinion of Zayd: Out of fifteen shares, for the grandfather is one-third (five shares), for the brother of the same father are four, for the sister of the same father are two shares, and for the two sisters of the same father and mother are four. Then the brother and sister of the same father return their portion to the two sisters of the same father and mother; they complete the one-third, and nothing remains for them. Regarding two sisters of the same father and mother, two sisters of the same father, and a grandfather: In the opinion of Ali and Abdullah: For the two sisters of the same father and mother are two-thirds, for the grandfather is what remains, and there is nothing for the two sisters of the same father. In the opinion of Zayd: Out of six shares, for the grandfather are two shares, for the two sisters of the same father and mother are two shares, and for the two sisters of the same father are two shares. Then the two sisters of the same father return their two shares to the two sisters of the same father and mother, so they complete the two-thirds, and nothing remains for them. Regarding a sister of the same father and mother, three sisters of the same father, and a grandfather: In the opinion of Ali and Abdullah: For the sister of the same father and mother is one-half, for the sisters of the same father is one-sixth to complete the two-thirds, and for the grandfather is what remains. In the opinion of Zayd: Eighteen shares; for the grandfather is one-third (six), for the sister of the same father and mother are three shares, for the sisters of the same father are nine shares. Then the sisters of the same father return six shares to the sister of the same father and mother, so she completes the half (nine), and what remains for them is one share each. Regarding two sisters of the same father and mother, a brother, and two sisters of the same father, and a grandfather: In the opinion of Ali: For the two sisters of the same father and mother are two-thirds, for the grandfather is one-sixth, and what remains is between the brother and the two sisters of the same father, for the male the like of the portion of two females. In the opinion of Abdullah: For the two sisters of the same father and mother are two-thirds, for the grandfather is what remains, and there is nothing for the brother and the two sisters of the same father. Regarding a mother, a sister, and a grandfather: In the opinion of Ali: For the sister is one-half, for the mother is one-third, and for the grandfather is what remains. In the opinion of Zayd: Out of nine shares, for the mother is one-third (three), for the grandfather are four, and for the sister are two shares; he placed her with them in the position of a brother. In the opinion of Uthman: For the mother is one-third, for the grandfather is one-third, and for the sister is one-third. In the opinion of Ibn Abbas: For the mother is one-third, for the grandfather is what remains, and there is nothing for the sister. He did not use to grant a brother and sister anything with a grandfather. In the opinion of Ibn Mas'ud: For the sister is one-half, for the mother is one-sixth, and for the grandfather is one-third.
حدثنا يزيد بن هارون قال أخبرنا محمد بن سالم عن الشعبي في أخت لأب وأم وأخ وأخت لأب وجد في قول علي للأخت من الأب والأم النصف وما بقي فبين الجد والأخت والأخ من الأب على الأخماس للجد خمسان وللأخت خمس وفي قول عبد الله للأخت من الأب والأم النصف وللجد ما بقي وليس للأخ والأخت من الأب شيء وفي قول زيد من ثمانية عشر سهما للجد الثلث ستة وللأخ من الأب ستة وللأخت من الأب والأم ثلاثة وللأخت من الأب [ و ] الأخ والأخت ثلاثة ثم يرد من الأب على الأخت من الأب والأم ستة أسهم فاستكملت النصف تسعة وبقي لهما ثلاثة أسهم للأخ سهمان وللأخت سهم وفي أختين لأب وأم وأخ لأب وجد في قول علي للأختين من الأب والأم الثلثان وما بقي فبين الجد والأخ وفي قول عبد الله للأختين من الأب والأم الثلثان وللجد ما بقي وليس للأخ من الأب شيء وفي قول زيد هي ثلاثة أسهم للجد سهم وللأخ سهم وللأختين سهم ثم يرد الأخ من الأب على الأختين من الأب والأم سهمه فتستكملان الثلثين ولم يبق له شيء وفي أختين لأب وأم وأخت لأب وجد في قول علي وعبد الله للأختين للأب والأم الثلثان وما بقي للجد وليس للأخت من الأب شيء وفي قول زيد من خمسة أسهم للجد سهمان وللأختين من الأب والأم سهمان وللأخت من الأب سهم ثم ترد الأخت من الأب على الأختين من الأب والأم سهمهما ولم يبق لها شيء وفي أختين لأب وأم وأخ وأخت لأب وجد في قول علي للأختين من الأب والأم الثلثان وللجد السدس وما بقي فبين الأخت والأخ من الأب للذكر مثل حظ الأنثيين وفي قول عبد الله للأختين من الأب والأم الثلثان وللجد ما بقي وليس للأخ والأخت من الأب شيء وفي قول زيد من خمسة عشر سهما للجد الثلث خمسة أسهم وللأخ من الأب أربعة وللأخت من الأب سهمان وللأختين من الأب والأم أربعة ثم يرد الأخ والأخت من الأب على الأختين من الأب نصيبهما تستكملان الثلث ولم يبق لهما شيء وفي أختين لأب وأم وأختين لأب وجد في قول علي وعبد الله للأختين من الأب والأم الثلثان وللجد ما بقي وليس للأختين من الأب شيء وفي قول زيد من ستة أسهم للجد سهمان وللأختين من الأب والأم سهمان وللأختين من الأب سهمان ثم ترد الأختان من الأب على الأختين من الأب والأم سهميهما فتستكملان الثلثين ولم يبق لهما شيء وفي أخت لأب وأم وثلاث أخوات لأب وجد في قول علي وعبد الله للأخت من الأب والأم النصف وللأخوات من ثلاث السدس تكملة الثلثين وللجد ما بقي وفي قول زيد ثمانية عشر سهما للجد الثلث ستة وللأخت من الأب والأم ثلاثة أسهم وللأخوات للجد الثلث ستة وللأخت من الأب والأم ثلاثة أسهم وللأخوات من الأب تسعة أسهم ثم ترد الأخوات من الأب على الأخت من الأب والأم ستة أسهم فاستكملت النصف تسعة وما بقي لهن سهم سهم وفي أختين لأب وأم وأخ وأختين لأب وجد في قول علي للأختين من الأب والأم الثلثان وللجد السدس وما بقي فبين الأخ والأختين من الأب للذكر مثل حظ الأنثيين وفي قول عبد الله للأختين من الأب والأم الثلثان وللجد ما بقي وليس للأخ والأختين من الأب شيء وفي أم وأخت وجد في قول علي للأخت النصف وللأم الثلث وللجد ما بقي وفي قول زيد من تسعة أسهم للأم الثلث ثلاثة وللجد أربعة وللأخت سهمان جعله معهما بمنزلة الأخ وفي قول عثمان للأم الثلث وللجد الثلث وللأخت الثلث وفي قول بن عباس للأم الثلث وللجد ما بقي ليس للأخت شيء لم يكن يورث أخا وأختا مع جد شيئا وفي قول بن مسعود للأخت النصف وللأم السدس وللجد الثلث
