Musannaf Ibn Abi Shayba 26:456

Sahl ibn Yusuf narrated to us, from ‘Amr, from al-Hasan, regarding the newborn who is born and does not cry out (at birth), he said: If it moves, and it is known that its movement is from life and not from a spasm, it inherits. And if its movement was only a spasm and not from life, it does not inherit.
