Hadith 26:595
Al-Fadl ibn Dukayn narrated to us, he said: Zakariya narrated to us, I heard Amir saying regarding a woman who died and she had three male sons and two daughters, one of whom was absent in al-Sham and the other was with her. She claimed that she had wealth with her daughter who was in al-Sham, and she said to her sons, "I would like for you to demand for her the wealth that is with her, by means of what she receives of my inheritance." They said, "Yes." She said, "And I would like for you to give what she receives of my inheritance to her sister, so that her share is like the share of a man among you." They said, "Yes." Then her daughter came after they had divided the inheritance and demanded what she was entitled to of her inheritance. She said, "There was no wealth of hers with me." Ibrahim was asked, and he said, "It is taken from each person among them equally and returned to her." And Amir said, "One of the two shares that the girl received is taken and returned to her sister, so each one of them receives a share, and for each man is two shares."
حدثنا الفضل بن دكين قال ثنا زكريا سمعت عامرا يقول في امرأة توفيت ولها ثلاثة بنين ذكور وابنتان إحداهما غائبة بالشام والأخرى عندها فزعمت أن لها عند ابنتها التي بالشام مالا وأنها قالت لبنيها أحب أن تطلبوا لها المال الذي عندها بما يصيبها من ميراثي فقالوا نعم قالت [ واحب ] أن تجعلوا ما يصيبها من ميراثي لأختها فنصيبها كنصيب رجل منكم فقالوا نعم ثم إن ابنتها جاءت بعد ما اقتسموا الميراث فطلبت ما يصيبها من ميراثها قالت لم يكن لها عندي مال فسئل إبراهيم فقال يؤخذ من كل إنسان منهم بالسوية فيرد عليها وقال عامر يؤخذ أحد السهمين اللذين أصابت الجارية فيرد على أختها فيصيب كل واحدة منهما سهم ولكل رجل سهمان
