Hadith 26:63

Ibn Fudayl narrated to us, from Bassam, from Fudayl, from Ibrahim, regarding a woman who left behind her paternal uncles, one of whom was her maternal half-brother. Ali and Zayd judged regarding her that her maternal half-brother receives one-sixth, and then he is a partner with them in the remainder of the wealth. Ibn Mas’ud judged regarding her that the entire wealth belongs to him, and this is because of a cause that exists in the partnership, then his family accepts Islam afterwards. Abu Bakr said: So this, according to the opinion of Ali and Zayd, is out of six shares, and according to the opinion of Abdullah [Ibn Mas’ud], it is out of one share, because it is the entire wealth.

حدثنا بن فضيل عن بسام عن فضيل عن إبراهيم في امرأة تركت أعمامها أحدهم أخوها لأمها فقضى فيها علي وزيد أن لأخيها لأمها السدس ثم هو شريكهم بعد في المال وقضى فيها بن مسعود أن المال كله له وهذا بسبب يكون في الشرك ثم يسلم أهله بعد قال أبو بكر فهذه في قول علي وزيد من ستة أسهم وفي قول عبد الله من سهم واحد لأنه المال كله
