Hadith 20:2
Abu Bakr narrated to us, he said: Ibn Idris narrated to us, from Ibn Jurayj, from Abu al-Zubayr, from Jabir, who said: The Messenger of Allah (may Allah bless him and grant him peace) decreed the right of pre-emption (*shuf'ah*) in every partnership that has not been divided, whether it is a house or a garden. It is not lawful for him to sell until he asks permission from his partner. If he wishes, he takes it, and if he wishes, he leaves it. If he sells without asking his permission, then he (the partner) has more right to it.
حدثنا أبو بكر قال حدثنا إبن إدريس عن بن جريج عن أبي الزبير عن جابر قال قضى رسول الله صلى الله عليه وسلم بالشفعة في كل شركة لم تقسم ربعة أو حائط لا يحل له [ أن يبيع ] حتى يستأذن شريكه فإن شاء أخذ وإن شاء ترك فإن باع ولم يؤذنه فهو أحق به
