Hadith 20:52

Abu Bakr narrated to us, he said: Yazid bin Harun narrated to us, from Muhammad bin Ishaq, from Abu Ja'far Muhammad bin Ali, and from al-Zuhri, from Sa'id bin al-Musayyib, and from Aban bin Salih, from Mujahid; they said: Two wives of Hamal bin Malik bin al-Nabigha became jealous of one another. One of them attacked the other with a tent pole and struck her, causing her to miscarry what was in her womb, and she died. This was raised to the Messenger of Allah (may Allah bless him and grant him peace). He judged her blood money to be upon the *aqilah* (the paternal relatives) of the killer, and he judged for the fetus a *ghurrah* (compensation) of a male slave or a female slave. The father of the killer—or her paternal uncle—said: "Shall I pay blood money for one who did not eat, nor drink, nor cry out, nor wail? And such as that is void." The Messenger of Allah (may Allah bless him and grant him peace) said: "Indeed, this one speaks with the speech of a poet. Yes, there is in it a *ghurrah* of a male slave or a female slave."

حدثنا أبو بكر قال حدثنا يزيد بن هارون عن محمد بن إسحاق عن أبي جعفر محمد بن علي وعن الزهري عن سعيد بن المسيب وعن أبان بن صالح عن مجاهد قالوا تغايرت امرأتان لحمل بن مالك بن النابغة فحملت احداهما على الأخرى بعمود فسطاط فضربتها وألقت ما في بطنها وماتت فرفع ذلك إلى رسول الله صلى الله عليه وسلم فقضى بديتها على عاقلة القاتلة وقضى في الجنين بغرة عبد أو امة فقال أبو القاتلة أو عمها أندي من لا أكل ولا شرب ولا صاح ولا استهل ومثل ذلك يطل فقال رسول الله صلى الله عليه وسلم إن هذا يقول بقول شاعر نعم فيه غرة عبد أو أمة
