Musannaf Ibn Abi Shayba 20:70

Shababa narrated to us, from Ibn Abi Dhi'b, from al-Zuhri, that the Prophet, peace and blessings of Allah be upon him, decreed regarding the *qasamah* (oath-taking in homicide cases) that the oath is upon the defendant.
