Musannaf Ibn Abi Shayba 9:105

Sahl ibn Yusuf narrated to us, from ‘Amr, from al-Hasan, who said: If the guardian and the woman disagree, the authority shall examine the matter. If the guardian is causing harm, he shall marry her off. Otherwise, he shall return her affair to her guardian.
