Musannaf Ibn Abi Shayba 9:1182

Ghundar narrated to us, from Shu'bah, who said: I asked al-Hakam and Hammad about a man who married a woman to make her lawful for her [previous] husband. Al-Hakam said: He keeps her. And Hammad said: It is more beloved to me that he separates from her.
