Musannaf Ibn Abi Shayba 9:1214

Ibn Abi Za’idah narrated to us, from Dawud, from al-Sha’bi, from Alqama, who said: A man came to Ibn Mas’ud and said: "A man among us married a woman, but he did not specify a dowry for her, nor did he have intercourse with her, until he died." Ibn Mas’ud said: "I have not been asked about anything since I parted from the Prophet, may Allah bless him and grant him peace, that is more difficult for me than this. Ask someone else." They hesitated regarding it for a month. Then he said: "Whom shall I ask while you are the most prominent of the companions of Muhammad in this city? I will say my opinion regarding it; if it is correct, then it is from Allah, and if it is a mistake, then it is from me and from Satan. I am of the opinion that she has the dowry of her peers, neither less nor more, and she has the inheritance, and she must observe the waiting period of a woman whose husband has died." Some people from Ashja’ said: "We bear witness that the Messenger of Allah, may Allah bless him and grant him peace, judged the same as you have judged regarding a woman among us called Birwa’ bint Washiq." He said: And I did not see Ibn Mas’ud rejoice over anything as he rejoiced on that day.
