Musannaf Ibn Abi Shayba 9:1295

Ibn Numayr narrated to us, from Isma'il, from al-Sha'bi, from Masruq, who said: 'Umar decreed regarding a woman who married during her waiting period ('iddah) that they be separated as long as they live, and that her dowry be placed in the public treasury (Bayt al-Mal). He said: "Her marriage was forbidden, so her dowry is forbidden." And he decreed regarding her that they be separated, and she shall complete the remainder of the waiting period of the first husband, then she shall observe a waiting period of three menstrual cycles, and she is entitled to the dowry for what he made lawful of her private parts. Then, if he wishes, he may propose to her after that.
