Musannaf Ibn Abi Shayba 9:1304

Hushaym narrated to us, from Isma'il ibn Salim, from al-Sha'bi, who said: If a man marries a woman upon her judgment or his judgment, and they act unjustly regarding the dowry, if they act unjustly, it is returned to the dowry of the like of her, neither deficient nor excessive, and the marriage is valid.
