Musannaf Ibn Abi Shayba 9:1401

Ibn Mahdi narrated to us, from Hammad ibn Salamah, from Matar, from al-Hakam, who said: If he has sexual intercourse with his *mukātabah* (a slave woman with a contract of manumission), she becomes his *umm al-walad* (a slave woman who has borne her master a child). If he forced her, then he is liable for the *‘aqr* (compensation for loss of virginity/damages) and the *hadd* (prescribed punishment). If she consented to him, then he is liable for the *hadd*, but he is not liable for the *‘aqr*.
