Hadith 9:1569

Abu Dawud al-Tayalisi narrated to us, from Hammad ibn Salamah, from Abu Bishr, from al-Sha’bi, that there were some women in al-Sham who were gesturing, looking, and playing with a rag. One of them mounted the other, and the other one ruptured, and her virginity was removed. This was raised to ‘Abd al-Malik ibn Marwan, so he asked Fadalah ibn ‘Ubayd and Qabisah ibn Dhu’ayb about it. They both said: "The blood money (diyah) is upon them, and the share of the one [who did it] is lifted." Ibn Mughaffal said: "It is seen from her semen (nutfa) to the one who ruptured her." Al-Sha’bi said: "And I hold that view, and she is entitled to her compensation (’aqr)."

حدثنا أبو داود الطيالسي عن حماد بن سلمة عن أبي بشر عن الشعبي أن نسوة كن بالشام فأشرن ونظرن ولعبن الخرقة فركبت واحدة الأخرى وبجست الأخرى فأذهبت عذرتها فرفع ذلك إلى عبد الملك بن مروان فسال عن ذلك فضالة بن عبيد وقبيصة بن ذؤيب فقالا عليهن الدية وترفع نصيب واحدة وقال بن مغفل يرى من نطفها إلى باجستها وقال الشعبي وأنا أرى ذلك ولها عقرها
