Musannaf Ibn Abi Shayba 9:211

Jarir narrated to us, from Mughira, from Ibrahim, from al-Sha'bi, who said: If a slave woman is under [the marriage of] a free man, and he purchases her, the marriage is void. She becomes a slave girl for him, and he may have intercourse with her if he wishes.
