Hadith 9:32
Mu'tamir narrated to us, from his father, who said: I said to al-Hasan: "A slave girl from the people of the land—meaning she has no master—a man proposed to her, and a man from her neighbors married her." He said: "The commander (Amir) marries her off." I said: "But she is weaker than that (i.e., she cannot reach the commander)." He said: "Then let her speak to a man who will judge for her with the commander." I said: "But she is weaker than that." He said: "I do not know anything other than that." I said to him: "Then the judge?" He said: "Except that he makes the judge a concession."
حدثنا معتمر عن أبيه قال قلت للحسن جارية من أهل الأرض يعني ليس لها مولى خطبها رجل تزوجها رجل من جيرانها قال تألي الأمير قال فإنها أضعف من ذلك قال فتكلم رجلا يحكم لها الأمير قال فإنها أضعف من ذلك قال لا أعلم إلا ذلك قال قلت له فالقاضي إذا إلا أنه يجعل القاضي رخصة
