Hadith 9:366

Ibn ‘Ulayyah narrated to us, from Ibn Jurayj, from Abu Bakr ibn Hafs ibn ‘Umar ibn Sa‘d, that Muslim ibn ‘Uwaymir ibn al-Ajda‘, from the Banu Bakr ibn Kinanah, informed him that his father married him to a woman in Ta’if. He said: I did not have intercourse with her until ‘Umar passed away. [Then I looked] at her mother, and her mother possessed much wealth. He [the father] said to me: "Do you desire her mother?" I said: "I would like that, but how, when I have married her daughter?" He said: So I asked Ibn ‘Abbas, and he said: "Marry her." And I asked Ibn ‘Umar, and he said: "Do not marry her." He said: So Abu ‘Uwaymir wrote to Mu‘awiyah regarding that, and informed him in his letter of what Ibn ‘Abbas had said and what Ibn ‘Umar had said. Mu‘awiyah wrote back to him: "I do not make lawful what Allah has made unlawful, nor do I make unlawful what Allah has made lawful. That is up to you, and women are many." He said: So he did not forbid me, nor did he give me permission, and my father turned away from her and did not marry her.

حدثنا بن علية عن بن جريج عن أبي بكر بن حفص بن عمر بن سعد أن مسلم بن عويمر بن الأجدع من بني بكر بن كنانة أخبره أن أباه أنكحه امرأة بالطائف قال فلم أجامعها حتى توفي عمر عن أمها وأمها ذات مال كثير فقال لي هل لك في أمها فقلت وددت وكيف وقد نكحت ابنتها قال فسألت بن عباس فقال انكحها وسألت بن عمر فقال لا تنكحها قال فكتب أبو عويمر في ذلك إلى معاوية وأخبره في كتابه بما قال بن عباس وبما قال بن عمر فكتب إليه معاوية لا أحل ما حرم الله ولا أحرم ما أحل الله وأنت وذاك والنساء كثير قال فلم ينهني ولم يأذن لي وانصرف أبي عنها فلم ينكحها
