Hadith 9:53
Yahya ibn Adam narrated to us, he said: Sufyan narrated to us, from Abu Qays, from Huzayl, who said: A woman whose maternal uncle had married her off was brought to Ali. Ali said: "He has permitted the marriage." Sufyan said: "It is not permissible, because he is not a guardian." Ali ibn Salih said: "It is permissible, because when Ali permitted it, he was in the position of the guardian."
حدثنا يحيى بن آدم قال نا سفيان عن أبي قيس عن هزيل قال رفعت إلى علي امرأة زوجها خالها قال فأجاز علي النكاح قال وقال سفيان لايجوز لأنه غير ولي وقال علي بن صالح هو جائز لأن عليا حين أجازه كان بمنزلة الولي
