Hadith 9:81
Sallam narrated to us, from Abu Ishaq, from Abu Burdah, who said: The Messenger of Allah (may Allah bless him and grant him peace) said: "Any orphan girl who is proposed to, she shall not be married until she is consulted. If she gives consent, then she may be married, and her consent is her silence. But if she refuses, she shall not be married."
حدثنا سلام عن أبي إسحاق عن أبي بردة قال قال رسول الله صلى الله عليه وسلم أيما يتيمة خطبت فلا تنكح حتى تستأمر فإن هي أقرت فلتنكح وإقرارها سكوتها وإن أنكرت فلا تنكح
