Hadith 9:85
Abu Bakr narrated to us, he said: Hushaym narrated to us, from Mujalid, from al-Sha'bi, from Ali, that he used to say: When the orphan girl is approached [for marriage], if she remains silent, then that is her consent. And if she dislikes it, she shall not be married.
حدثنا أبو بكر قال نا هشيم عن مجالد عن الشعبي عن علي أنه كان يقول إذا رفعت اليتيمة فإن سكتت فهو رضاها وإن كرهت لم تزوج
