Hadith 36:387

Al-Hasan ibn Musa narrated to us, he said: Shayban narrated to us, from Yahya, he said: Abu Salamah informed me that Abu Hurayrah informed him that Khuza'ah killed a man from Banu Layth in the year of the conquest of Makkah for a person of theirs whom they had killed. The Messenger of Allah (ﷺ) was informed of that, so he mounted his riding beast and delivered a sermon. He said: "Indeed, Allah restrained the elephant from Makkah and gave His Messenger and the believers authority over it. Behold, it was made lawful for me for an hour of the day. Behold, it is, at this hour of mine, sacred. Its thorns must not be cut, its trees must not be felled, and its lost property must not be picked up except by one who announces it. Whoever has a person killed, he has the choice of two options: either he kills, or he accepts blood money from the family of the slain." He said: Then a man came, who was called Abu Shah, and said: "Write it down for me, O Messenger of Allah." He said: "Write it down for Abu Shah." A man from Quraysh said: "Except for the *idhkhir* (lemon grass), O Messenger of Allah, for we use it in our houses and our graves." The Messenger of Allah (ﷺ) said: "Except for the *idhkhir*."

حدثنا الحسن بن موسى قال حدثنا شيبان عن يحيى قال أخبرني أبو سلمة أن أبا هريرة أخبره أن خزاعة قتلوا رجلا من بني ليث عام فتح مكة بقتيل منهم قتلوه فأخبر بذلك رسول الله صلى الله عليه وسلم فركب راحلته فخطب فقال إن الله حبس عن مكة الفيل وسلط عليها رسوله والمؤمنين ألا وإنها أحلت لي ساعة من النهار ألا وإنها ساعتي هذه حرام لا يختلى شوكها ولا يعضد شجرها ولا يلتقط ساقطتها إلا منشد ومن قتل له قتيل فهو بخير النظرين إما أن يقتل وإما أن يفادي أهل القتيل قال فجاء رجل يقال له أبو شاه فقال اكتب لي يا رسول الله قال اكتبوا لأبي شاه فقال رجل من قريش إلا الاذخر يا رسول الله فانا نجعله في بيوتنا وقبورنا فقال رسول الله صلى الله عليه وسلم إلا الاذخر
