Musannaf Ibn Abi Shayba 28:261

Abu Usama narrated to us, from Mujalid, from Amir, who said: Harithah ibn Badr al-Tamimi was from the people of Basra. He had caused corruption in the land and waged war. He spoke to al-Hasan ibn Ali, Ibn Ja'far, Ibn Abbas, and others from Quraysh, so they spoke to Ali, but he did not grant him safety. He then went to Sa'id ibn Qays al-Hamdani and spoke to him. Sa'id went to Ali, leaving him [Harithah] in his house, and said: "O Commander of the Faithful, what do you say regarding one who wages war against Allah and His Messenger and strives to cause corruption in the land?" He recited: "Indeed, the penalty for those who wage war against Allah and His Messenger..." until he recited the entire verse. Sa'id said: "Have you considered one who repents before we are able to seize him?" Ali said: "I say as He [Allah] said, and it is accepted from him." He said: "Then Harithah ibn Badr has repented before we were able to seize him." So he sent for him, brought him in, granted him safety, and wrote a document for him. Harithah said: "Oh, convey to Hamdan, if you meet them, A greeting; may no enemy who finds fault with them be greeted. By the life of your father, indeed Hamdan fears Allah, and their orator judges by the Book. My head turns gray and our minds are unsettled By the thunders of death around us and its lightnings. And we find death sweet to our souls, While we leave another [life] that we do not taste." Ibn Amir said: I narrated this hadith to Abdullah ibn Ja'far, and he said: "We were more deserving of these verses than Hamdan."
