Musannaf Ibn Abi Shayba 28:266

Muhammad ibn Bakr narrated to us, from Ibn Jurayj, who said: It was narrated to me from Sa’id ibn Jubayr, who said: "Whoever wages war is a *muharib* (warrior/brigand)." Sa’id said: "If he sheds blood, he is killed. If he sheds blood and takes wealth, he is crucified, for crucifixion is the most severe. If he takes wealth but does not shed blood, his hand and his foot are cut off, due to His saying: '...or their hands and their feet are cut off from opposite sides.' If he dies, his repentance is between him and Allah, but the prescribed punishment (*hadd*) is carried out upon him."
