Hadith 28:267
Zayd ibn al-Hubab narrated to us, from Abu Hilal, from Qatada, from Murriq al-Ijli, who said: When the *muharib* (one who wages war/commits highway robbery) is seized and brought before the Imam: If he took wealth and did not kill, he is to have his limbs cut off and is not to be killed. If he took wealth and killed, he is to have his limbs cut off and be crucified. If he did not take wealth and did not kill, he is not to have his limbs cut off. If he did not take wealth and did not kill, but caused hardship to the Muslims, he is to be banished.
حدثنا زيد بن حباب عن أبي هلال عن قتادة عن مورق العجلي قال إذا أخذ المحارب فرفع إلى الإمام فإن كان أخذ المال ولم يقتل قطع ولم يقتل وإن أخذ المال وقتل قطع وصلب وإن كان لم يأخذ المال ولم يقتل لم يقطع وإن كان لم يأخذ المال ولم يقتل وشاق المسلمين نفي
