Musannaf Ibn Abi Shayba 28:272

Zayd ibn al-Hubab narrated to us, from Abu Hilal, from Qatadah, from Sa’id ibn al-Musayyib, regarding the *muharib* (one who wages war/commits highway robbery): When he is brought before the Imam, he may do with him whatever he wishes.
