Musannaf Ibn Abi Shayba 28:298

Abu Usama narrated to us, he said: Ishaq bin Sulayman narrated to us, from al-Shaybani, from his father, who said: 'Amr bin Abi Qurra narrated to me, he said: A letter from 'Umar bin al-Khattab came to us, [stating] that some people take from this wealth to strive (jihad) in the way of Allah, then they oppose [that] and do not strive. So whoever among them does that, then we are more entitled to his wealth until we take back from him what he took. Ishaq said: So I stood up to Asad bin 'Amr and said: "Do you not see what 'Amr bin Abi Qurra narrated to me?" And I narrated it to him. He said: "He spoke the truth; the letter of 'Umar came with it."
