Musannaf Ibn Abi Shayba 28:333

Abu Usama narrated to us, from Mujalid, from Amir, from Jarir, from the Prophet, peace and blessings of Allah be upon him, who said: "Any slave who flees to the land of the enemy, the protection (dhimma) has been absolved from him."
