Musannaf Ibn Abi Shayba 28:450

Waki’ narrated to us, he said: Muhammad ibn Abdullah al-Shu’aythi narrated to us, from Layth Abu al-Mutawakkil, from Malik ibn Aws ibn al-Hadathan, he said: I heard Umar ibn al-Khattab saying: "There is no one among the Muslims except that he has a share in this *fay* (spoils/public treasury), except for an owned slave. And if I remain, the shepherd will surely reach his share of this *fay* while he is in the mountains of Sana’a."
