Musannaf Ibn Abi Shayba 28:835

Hafs ibn Ghiyath narrated to us, from Hajjaj, from al-Hakam, from Ibrahim, who said: Regarding the property of the Muslims that the polytheists gained control over, and then the Muslims gained control over it: if it has been divided, then he [the original owner] is more entitled to it for its price. And if it has not been divided, it is returned to him.
