Hadith 28:836
Waki’ narrated to us, he said: Sufyan narrated to us, from Simak, from Tamim ibn Tarfah, who said: The Muslims captured a she-camel belonging to a man from the Muslims, and a man from the enemy bought it. Its owner disputed with him before the Prophet, may Allah bless him and grant him peace. He (the owner) established the evidence, so the Prophet, may Allah bless him and grant him peace, judged that he should pay him the price for which he bought it from the enemy, otherwise he should leave him and it (the camel) alone.
حدثنا وكيع قال ثنا سفيان عن سماك عن تميم بن طرفة قال أصاب المسلمون ناقة لرجل من المسلمين فاشتراها رجل من العدو فخاصمه صاحبها إلى النبي صلى الله عليه وسلم فأقام البينة فقضى النبي صلى الله عليه وسلم أن يدفع إليه الثمن الذي اشتراها به من العدو وإلا خلى بينه وبينها
