Musannaf Ibn Abi Shayba 7:462

'Abd al-Rahim narrated to us, from Sa'id, from Qatada, from al-Hasan and Sa'id ibn al-Musayyib, and from Abu Ma'shar, from Ibrahim, they said: "If he performed *zihar* upon her and did not include in it 'if I have intercourse with you,' then there is no prescribed punishment (*hadd*) in that, and there is no set time; when he performs the expiation (*kaffara*), he may have intercourse with her."
