Musannaf Ibn Abi Shayba 35:250

Narrated to us Sharik, from Abu Ishaq, from ‘Ata, from Rafi‘ ibn Khadij, who attributed it (to the Prophet), he said: Whoever plants in the land of a people without their permission, his expenditure shall be returned to him, and he shall have nothing of the crop.
