Hadith 35:293
Ibn ‘Uyaynah narrated to us, from ‘Amr, from Tawus, who said: It was said to Safwan ibn Umayyah while he was in the upper part of Makkah, "There is no religion for one who does not migrate." He said, "By Allah, I will not reach my family until I come to al-Madinah." So he came to al-Madinah and stayed with al-‘Abbas. He lay down in the mosque with his cloak under his head. A thief came and stole it from under his head. He was brought to the Prophet (peace and blessings of Allah be upon him), who said, "This is a thief." He ordered that he be punished, so his hand was cut off. He (Safwan) said, "It is for him (as a gift)." He (the Prophet) said, "Why not before you brought him to me?" And it was mentioned that Abu Hanifah said: If he gifts it to him, the prescribed punishment (hadd) is averted from him.
حدثنا بن عيينة عن عمرو عن طاوس قال قيل لصفوان بن أمية وهو بأعلى مكة لا دين لمن لم يهاجر فقال والله لا أصل إلى أهلي حتى آتي المدينة فأتى المدينة فنزل على العباس فاضطجع في المسجد وخميصته تحت رأسه فجاء سارق فسرقها من تحت رأسه فأتى به النبي صلى الله عليه وسلم فقال إن هذا سارق فأمر به فقطع فقال هي له فقال فهلا قبل أن تأتيني به وذكر أن أبا حنيفة قال إذا وهبها له درئ عنه الحد
