Musannaf Ibn Abi Shayba 35:66

Ibn ‘Uyaynah narrated to us, from Ibn Tawus, from his father: "Did you not see that Hajar al-Madari informed me that in the charity (sadaqah) of the Prophet, may Allah bless him and grant him peace, its people may eat from it in a recognized manner, not a rejected one." And he mentioned that Abu Hanifah said: "It is permissible for the heirs to return that."
