Musannaf Ibn Abi Shayba 13:1201

Abu Bakr narrated to us, he said: Khalid ibn al-Harith narrated to us, from Ibn Abi Arubah, from Qatadah, from Khallas, from Abu Rafi, from Abu Hurayrah, that two men disputed before the Prophet, peace and blessings of Allah be upon him, regarding an animal, and there was no evidence between them. So the Messenger of Allah, peace and blessings of Allah be upon him, ordered them to draw lots for the oath.
