Musannaf Ibn Abi Shayba 13:1313

Abu Bakr narrated to us, he said: Ali bin Mushir narrated to us, from Dawud, from al-Sha’bi, who said: There was a beast in the hands of some people from the Azd. A group claimed it, and they established evidence that it was their beast which they had lost during the time of Umar bin Abd al-Aziz. Those in whose hands it was established evidence that they had bred it. So, that was referred to their judge, Abd al-Rahman bin Udhaynah. These people would come in the morning with evidence, and the others would come in the evening with more than them. So he wrote about that to Shurayh. He (Shurayh) wrote back to him: "I have nothing to do with the excessive disputing and the multiplying (of evidence). Those who established evidence that they bred it, while it is in their hands, are more entitled. And those others are more entitled to suspicion."
