Musannaf Ibn Abi Shayba 13:1353

Abu Bakr narrated to us, he said: Waki’ narrated to us, from Sufyan, from Huzn ibn Bishr, from Raja’ ibn al-Harith, that a man made a contract for a runaway slave, so he took him to return him, but he ran away from him. He disputed with him before Shurayh, and he (Shurayh) held him liable for him. This reached Ali, so he said: "He judged poorly. He shall swear by Allah that he ran away from him, and there is no liability upon him."
