Musannaf Ibn Abi Shayba 13:1920

Abu Bakr narrated to us, he said: Ibn ‘Ulayyah narrated to us, from Layth, from Tawus, who said: If the wealth is abundant, then [the bequest is taken] from the entire wealth. And if it is little, then [it is taken] from the third.
