Musannaf Ibn Abi Shayba 13:2148

Abu Bakr narrated to us, he said: Hushaym narrated to us, from Isma'il ibn Salim, from al-Qasim ibn 'Abd al-Rahman, who said: I witnessed him, and two men disputed before him. One of them had bought an animal from the other. He [the buyer] said to al-Qasim: "Order him to give me a guarantor in case a claim (darak) arises against me regarding this animal." He [al-Qasim] said: "Did you stipulate that to him at the time of the sales contract?" He said: "No." He said: "He is not entitled to that."
