Musannaf Ibn Abi Shayba 13:2841

Abu Bakr narrated to us, he said: Waki’ narrated to us, he said: Isra’il narrated to us, from Ibrahim ibn ‘Amir ibn Mas’ud al-Jumahi, from Mu’awiyah ibn ‘Abd Allah ibn Ja’far, that a man mortgaged a house for a fixed term. When the mortgage term expired, the mortgagee said: "My house." The Messenger of Allah (peace and blessings of Allah be upon him) said: "The mortgage shall not be forfeited."
